Agreement to Terms

By using Tend, you agree to these Terms of Service. If you do not agree, please do not use the app.

Description of Service

Tend is a goal-tracking application that helps you set, track, and achieve your goals. The service includes goal creation, progress tracking, streaks, and progress visualization.

Account Registration

To use certain features, you may create an account using:

  • Email and password
  • Sign in with Apple
  • Sign in with Google
  • Facebook Login

You are responsible for maintaining the security of your account credentials.

Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose
  • Attempt to access other users' accounts
  • Interfere with the app's functionality
  • Reverse-engineer or copy the app

Intellectual Property

Tend and its content, features, and functionality are owned by us and protected by copyright and trademark laws.

User Content

You retain ownership of the goals and data you create. By using the app, you grant us a license to store and display your content to provide the service.

Subscriptions and Payments

Note: Subscription features are currently in development and testing. Subscriptions are not yet available for purchase.

When subscriptions become available:

  • Payment is processed through Apple's App Store
  • Subscriptions auto-renew unless cancelled 24 hours before the renewal date
  • Refunds are handled by Apple according to their policies

Disclaimer of Warranties

Tend is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free or uninterrupted.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

Termination

We may terminate or suspend your account at any time for violations of these terms. You may delete your account at any time from the app settings.

Changes to Terms

We may modify these terms at any time. Continued use of the app after changes constitutes acceptance of the new terms. We will notify you of significant changes through the app.

Governing Law

These terms are governed by the laws of Canada and the laws of the Province of Ontario, without regard to conflict of law provisions. Any disputes arising from these terms or your use of the app shall be resolved in the courts of Ontario, Canada.

Dispute Resolution

If you have a dispute with us, you agree to first contact us at hello@tend.quest to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to resolve disputes through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if your claims qualify.
